Washington is a no fault State meaning that bad behavior on the part of one party will not influence the property distribution in a dissolution. The Court makes a ‘fair and equitable’ distribution of property. This means the Court looks at the entirety of the case before making a decision on how the property, including debts, will be divided.

There are many different combinations on how property and debt can be split. There is no definite answer or formula. This allows the Court a great deal of discretion when making a decision. This is also one of the reasons many people will settle before trial, you never know which way a Court will decide and many do not want to spend a great deal of money to roll the dice so to speak.
